The General Terms and Conditions for the Allotment of Delhi Development Authority’s Freehold Built-Up Multistoried Residential Flats to the Individuals in DDA Housing Scheme 2010

1. The applicant must be a citizen of India.

2. Allotment of the freehold residential flats shall be made through draw of lots.

3. The applicant should have attained the age of majority. For this, an applicant should have completed 18 years of age as on the date of filling of the application for a flat.

4. Only such applications shall be deemed to be valid, which are accompanied by specific earnest money in the form of a demand draft or banker’s cheque in favor of ‘DDA Housing’ payable Delhi or New Delhi. Delhi Development Authority shall not accept earnest money in cash.

5. An application without the prescribed earnest money shall not be entertained and is liable to be rejected outright.

6. The applicant must not own any residential flat or plot in full or in part on leasehold or freehold basis in Delhi, New Delhi or Delhi Cantonment either in his or her own name or in the name of his or her wife or husband or in the name of his or her minor or dependent children.

7. In DDA Housing Scheme 2010, both husband and wife can apply for a flat. However, only one will be allotted flat in case both are found successful in the draw of lots.

8. One person can submit one application only.

9. A person who has already been allotted a plot, house, or flat constructed by the Delhi Development Authority or any other land owning department shall not be eligible to apply for another flat under DDA Housing Scheme 2010.

10. There is no income limit. The applicant can apply according to his or her requirement and affordability.

11. The applicant must have an account in any bank and the particulars must be filled in the application form. If allotted a flat, the entire allotment money for the flat will have to be made directly from the bank account of the allottee. The allottee will have to submit a certificate to this effect from his or her bank manager confirming this fact at the time of possession of the flat.

12. Applicant must have Permanent Account Number allotted under the provisions of Income Tax Act and the same must be quoted on the application form.

13. Along with the application form, the applicant has to submit:

(i) A self-attested photocopy of the PAN (Permanent Account Number) card allotted by Income Tax Department.

(ii) Proof of Residence – A self-attested photocopy of the passport, or identity card, or election card, or ration card, or driving license, or telephone bill, or electricity bill, or water bill, or house tax receipt, or bank passbook (page carrying name and address) or CGHS card.

(iii) A self-attested photocopy of the bank account number.

14. No interest shall be payable on the money of the applicant for the period of 4 months from the closing date of the scheme. However, interest at the rate of 5% per annum on the amount of earnest money for the period beyond four months of the closing the scheme shall be paid by the Delhi Development Authority (DDA) to the applicant, if the draw of lots is not held and earnest money is not refunded within a period of four months from the date of closing of the scheme.

15. The Delhi Development Authority (DDA) reserves the right to alter any term and condition or clause of the DDA Housing Scheme 2010 at its discretion as and when considered necessary.

16. The Delhi Development Authority (DDA) reserves the right to increase or decrease the number of flats on offer in the DDA Housing Scheme 2010. DDA also reserves the right to withdraw some or all flats depending on the circumstances.

17. The allotment under the DDA Housing Scheme 2010 shall be on the terms and conditions contained in the brochure, demand-cum-allotment letter and the DDA (Management & Disposal of Housing Estate) Regulations, 1968.

18. As per provisions contained in Regulations No. 17 of DDA (Management & Disposal of Housing Estate) Regulations, 1968, all rates, fees, taxes, charges, assessment of municipal or otherwise and other levies of whatsoever nature shall be borne by the allottee or the Registered Agency or Association of Apartment Owners’ as the case may be and shall be payable by the allottee or Association of Apartment Owners’ or Registered Agency within the period specified in this behalf.

19. In all the correspondence within DDA regarding allotment etc., the applicants are advised to quote their application form no. and the file no. etc. and such correspondence be addressed to Dy. Director Concerned, D-Block, Vikas Sadan, DDA, New Delhi-110 023.

20. In case of any grievance, the applicant can contact Director (H)-I / Director (H)-II, Commissioner (H) or the Vice-Chairman, DDA during their public hearing days. However, on financial issues the applicant is advised to first contact Financial Adviser (Housing), D-Block, First Floor, Vikas Sadan, New Delhi-110023.

21 It is not possible to check the eligibility of an applicant at the time of acceptance of the form. Therefore, those who are not eligible would register their name at their own risk and would not be entitled for allotment of flats if at a later stage it is detected that they are not eligible under the scheme.

22. The applicant should mention his/her PAN/GIR No. and I.T Circle/Ward/District The application form without this information shall be considered incomplete and is liable to be rejected.

23. The applications received after the prescribed closing date of DDA Housing Scheme 2010 will not be entertained.

24. Disputes, if any, regarding allotment related matters shall be subject to the jurisdiction of Delhi Courts only.
