YEIDA Yamunotri Housing Scheme BHS-04/2014 – Mortgage of the Flat for Raising Loan

Greater Noida (Uttar Pradesh, India), October 31, 2015

The Yamuna Expressway Industrial Development Authority (YEIDA) had launched a residential scheme of multistoried flats (YEIDA Scheme Code BHS-04/2014) in Sector-22A on October 23, 2014.

If an allottee of YEIDA Yamunotri Housing Scheme BHS-04/2014 desires to mortgage his or her multistory flat for raising loan, they can do so after execution of lease deed, provided they take prior consent of the Yamuna Expressway Industrial Development Authority (the lessor).

The Yamuna Expressway Industrial Development Authority will give permission for mortgaging his or her multistory flat to any scheduled bank or financial institution for raising loan subject to certain terms and conditions.

1. The flat owner will need to apply to the Yamuna Expressway Industrial Development Authority for granting permission to mortgage his or her flat. The Authority will decide these terms and conditions at the time of giving permission for mortgage.

2. In the event of sale or fore closure of the mortgaged or charged property, the Yamuna Expressway Industrial Development Authority shall be entitled to claim and recover such percentage, as decided by the Authority, of the unearned increase in the value of said land as first charge, having priority over the said mortgage charge. The decision of the Authority in respect of the market value of the said land shall be final and binding on all the parties concerned.

3. The Yamuna Expressway Industrial Development Authority shall have preemptive right to buy the mortgaged or charged property after deducting such percentage as decided by the Authority of the unearned increase as aforesaid.

4. The Yamuna Expressway Industrial Development Authority’s right to the recovery of the unearned increase and the preemptive right to buy the property as mentioned herein before shall apply equally to involuntary sale or transfer, be it by or through execution of decree of insolvency or court.

5. The Yamuna Expressway Industrial Development Authority shall not allow making any specification changes in multistoried flat to the allottee (lessee).

6. In case, there is any violation of a regulation or direction, if not compoundable, the Yamuna Expressway Industrial Development Authority will rectify the defect. In such a situation, the Authority will recover expenses incurred in carrying out such work from the allottee.

The last date of booking or registration for the YEIDA multistoried flats scheme BHS-04/2014 was on January 31, 2015.

The Yamuna Expressway Industrial Development Authority was to hold the lottery draw of lots for the YEIDA multistoried flats scheme BHS-04/2014 before March 31, 2015.
