PDA Enclave Dhuri Plots Scheme – Surrender or Cancellation

Patiala Urban Planning and Development Authority – Surrender or Cancellation of PDA Enclave Dhuri Plots

The Patiala Urban Planning and Development Authority (PDA) had launched a residential scheme of 210 freehold plots (PDA Scheme Code PDA Enclave Dhuri) in PDA Enclave Dhuri (District Sangrur) in Punjab on June 03, 2015.

Surrender or Cancellation of the Allotted Plot in PDA Enclave Dhuri Residential Plots Scheme

In case of surrender or refusal by the allottee at any stage after the draw or allotment of plot, the Patiala Urban Planning and Development Authority will take action as per provisions of the Punjab Regional and Town Planning and Development Act 1995, instructions and policies issued hereunder.

The Patiala Urban Planning and Development Authority will allow surrender of your allotted plot in PDA Enclave Dhuri residential plots scheme to the Authority, subject to the terms and conditions. The Authority shall also be free to exercise its rights of cancellation of allotment of a plot.

The Patiala Urban Planning and Development Authority shall also be free to exercise its rights of cancellation of allotment of a plot, subject to the specific clauses relating to cancellation.

If the allottee fails to execute the required legal documents within stipulated time, the Patiala Urban Planning and Development Authority may cancel the allotment and forfeit the deposited money.

PDA Enclave Dhuri Residential Plots Scheme – Surrender of the Allotted Plot

1. In case terms and conditions of allotment, as detailed above are acceptable, the allottee is required to send his or her acceptance by registered post along with a demand draft of 15% price of the plot within 30 days of issue of Letter of Intent (excluding date of issue).

2. If the applicant surrenders before lottery draw of lots is held or before issue of Letters of Intent (LOI), the Patiala Urban Planning and Development Authority will refund the Registration Money Deposit without interest after deducting an amount of Rs. 5000.

4. In case the applicant surrenders after the lottery draw of lots is held, but within 30 days from the date of allotment, the Patiala Urban Planning and Development Authority will refund 90% of Registration Money Deposit without interest after forfeiting 10% of the initial Earnest Money Deposit.

5. In case of refusal to accept the allotment offer, made through Letter of Intent (LOI) such refusal in writing through a registered post should be received within 30 days from the date of issue of LOI and in that case, 10% amount of earnest money shall be forfeited. In the event, such refusal is received after a period of 30 days from the issue of Letter of Intent, the entire earnest money deposited shall be forfeited.

6. In case, the applicant surrenders his or her plot after after 30 days from the date of allotment, the Patiala Urban Planning and Development Authority will forfeit the entire deposited money.

7. The Patiala Urban Planning and Development Authority shall make allotment through a draw of lots. However, the waiting list of applicants shall be allotted plots based on available plots as per seniority. The applicants, in waiting list, if not interested in the offered plot, will be refunded their earnest money after deducting 10% amount, if the refusal is submitted within 30 day from the date of offer.

8. In case, the applicant fails to deposit the due amount for his or her plot within the stipulated time, allotment will be liable for cancellation. In case of such cancellation, the Patiala Urban Planning and Development Authority will forfeit the money so deposited until the date of cancellation.

9. The Patiala Urban Planning and Development Authority will count the day of surrender of your allotment on the date on which application is received in the Authority office. The Authority will not entertain any subsequent claim based on a postal certificate.

PDA Enclave Dhuri Residential Plots Scheme – Cancellation of the Allotted Plot

1. If the information or documents supplied along with the application form or thereafter is found false or fabricated, such allotment shall be cancelled and the entire earnest money shall be forfeited along with institution of criminal proceedings against the applicant.

2. If an applicant has obtained the allotment through misrepresentation or suppression of material facts, the Patiala Urban Planning and Development Authority shall be free to cancel allotment of the plot.

3. If an applicant has violated directions issued, or rules or regulations framed by the Patiala Urban Planning and Development Authority or by any other statutory body, the Authority shall be free to cancel allotment of the plot.

4. If there is default on the part of the applicant or allottee for breach or violation of terms and conditions of registration or allotment or non-deposit of allotment amount, the Patiala Urban Planning and Development Authority shall be free to cancel allotment of the plot.

5. Only one application can be given by one family i.e. one or the other spouse or dependent children for one category (size) of plot. However, one applicant can apply for different category of plots (size wise) on separate application forms. In that case, earnest money will be charged with each application form but the applicant would be entitled to keep only one plot. In case the applicant is successful in more than one category, then in that case he or she will have to surrender the other plot(s) after giving option for retaining one plot with him or her within 30 days from the date of publication of the result of draw. If such successful applicant fails to inform about his or her surrender option(s) to the Patiala Urban Planning and Development Authority, then the Estate Officer, PDA, Patiala will have the right to cancel any of the extra plot(s) and the entire earnest money shall be forfeited.

In the event of cancellation, under sub-clause 1, 2, 3, 4, and 5 given above, the Patiala Urban Planning and Development Authority will forfeit the entire deposits until the date of cancellation and the Authority will resume possession of the plot with structure thereon, if any, and the allottee will have no right to claim any compensation thereof.
